Municipal Ordinance 03 S.2012

PROHIBITING SMOKING AND VAPING IN PUBLIC PLACES WITHIN THE MUNICIPALITY OF MLANG

Policy

It is hereby declared the policy of the Municipality to protect and promote the right to health of its constituents and to safeguard the environment by prohibiting smoking and vaping in public places.

Definition of Terms

  • Smoking refers to being in possession or control of a lit tobacco product, regardless of whether the smoke is being actively inhaled or exhaled.
  • Vaping refers to the act of inhaling and exhaling aerosol produced by electronic cigarettes, vapes, or similar devices.
  • Public Places include government buildings, schools, hospitals, health centers, markets, terminals, public utility vehicles, parks, covered courts, and other areas accessible to the general public.

Prohibited Acts

Smoking and vaping are strictly prohibited in all public places within the Municipality.

Penalties

  • First Offense – Fine of Five Hundred Pesos (₱500.00) or community service of not less than 8 hours.
  • Second Offense – Fine of One Thousand Pesos (₱1,000.00) or community service of not less than 24 hours.
  • Third and Succeeding Offenses – Fine of Two Thousand Pesos (₱2,000.00) and/or imprisonment of not more than 3 days, subject to the discretion of the court.

CURFEW FROM 8:00 P.M. TO 4:00 A.M. WITHIN THE MUNICIPALITY OF MLANG

Declaration of Policy

It is the policy of the Municipality to maintain peace and order, protect minors and vulnerable members of society, and deter crimes and unlawful activities during late hours of the night.

Coverage

This Ordinance shall cover all persons within the territorial jurisdiction of the Municipality of Mlang, except those exempted under Section 4 hereof.

Curfew Hours

A curfew is hereby imposed from 8:00 P.M. until 4:00 A.M. the following day. During these hours, no person shall loiter, roam, or stay in public places.

Exemptions

  • Individuals engaged in lawful employment or business and are on their way to or from work.
  • Persons attending to medical emergencies or seeking immediate health care.
  • Students and individuals attending official school, church, or community activities authorized by concerned authorities.
  • Emergency responders, uniformed personnel, and government officials in the performance of their duties.

Penalties

  • First Offense – Warning and notification of parent/guardian (for minors).
  • Second Offense – Fine of Five Hundred Pesos (₱500.00) or community service not less than 8 hours.
  • Third and Succeeding Offenses – Fine of One Thousand Pesos (₱1,000.00) and/or imprisonment of not more than 3 days, subject to the discretion of the court.

Responsibility of Parents/Guardians

Parents or guardians of minors found violating this Ordinance shall be held liable and may be required to attend counseling or pay the prescribed penalties.

Effectivity

This Ordinance shall take effect immediately upon approval and after publication/posting in at least three (3) conspicuous places within the Municipality.
